In this Privacy Notice, “we” and “us” refers to The Peach Grows Limited (“The Peach”)  “You” and “your” refers to each person who provides their personal data to us, including for the purposes of obtaining advice or other services from us.

We hold and process personal data about you in order to provide health and related advice and services. In doing so, we comply with relevant data protection legislation. 

What we do with your data

As a data controller, we collect and process your personal data for the purposes of providing health and related advice and services to you.  We also collect and process personal data for marketing and research purposes.

Most of the data we hold will be provided by you.  This includes your contact details and other information you have provided in order for us to provide you with advice and services.  In most cases we will only process that personal data with your explicit consent.  You are entitled to refuse to give that consent or to withdraw it at any time.  However, we will not be able to provide you with our services if you refuse to give consent or have withdrawn your consent to the processing of your personal data.

In some circumstances we will process your personal data because it is necessary for the legitimate interests of running our business and providing our services to our clients.

You may provide us with information about third parties, such as other members of your family. We assume that you have the consent of those individuals to provide us with this information and that you will share this privacy notice with them. We will not provide a copy of this notice to those individuals because doing so may cause a breach of the duty of confidentiality which we owe you. 

We may also hold some special categories or “sensitive” data about you, such as information relating to your health, race, sexual orientation, religious or philosophical beliefs or genetic or biometric data. We will only process such information with your explicit consent. 

Should a safeguarding concern arise, it may become necessary for us to disclose relevant confidential information to the relevant authorities without your consent.

The Peach uses Stripe for payment processing.  We will not collect or store your payment card details. That information is provided only to Stripe and is not shared with The Peach.  Stripe’s privacy policy can be viewed at:  https://stripe.com/en-gb/privacy 

The website and other information provided to users of our services may contain links to other sites that are not operated by The Peach.  We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Who else processes your data?

On occasions we may share your personal data with third parties selected by us for research purposes where we have a legitimate interest in carrying out that research.  

We may also from time to time use third parties to process your data for the purposes of the operation of the website and the provision of our services.  This may include website builders and third parties involved in the provision of any of the services.  These third parties include Squarespace, which we use to circulate newsletters and invitations.

Where any third party processes your data on our behalf, we require the processor to take adequate measures to protect your data. We will also ensure that personal identifiers will be removed from the data provided to any third party so far as possible.  

We may from time to time pass your personal data to unrelated third parties.  We will only do so where the third party has a legitimate interest in that processing and we consider that the use of that data by the third party should not be overridden by the need to protect your fundamental rights and freedoms. 

We may also share information with our regulators, advisers and auditors where necessary for the purposes of carrying out our business in compliance with regulatory and legal requirements.

Storage of your personal data

Whenever you seek our advice and services, it is important that we have access to as much background to your situation as possible.  This includes information previously provided by you to us. As a result, unless you inform us that you no longer wish us to provide you with advice or services, or instruct us to delete your personal data, we will retain your data.  We will take all reasonable measures to protect the security of that data.

We will also retain your personal data for so long as we may be required to do so by our insurers or regulators or to protect our interests.  

Your rights

You have the right to access your personal data and require that we rectify any errors in the data that we hold, or request that we erase your personal data. In some circumstances, you can also require that we restrict the way we process your personal data, object to its processing or request a copy of your personal data for the purposes of transmitting elsewhere. 

Where we have requested and obtained your consent to process particular information, you may withdraw that consent at any time.

The Peach may from time to time update this privacy notice.  The updated notice will be posted on this page and the effective date will be shown at the start of the notice.  You are advised to review this privacy notice periodically for any such changes.

General terms

Appointments

If you cancel an appointment with less than 48 hours notice or fail to attend an appointment, we reserve the right to charge you in full for that appointment.  

If we have to cancel an appointment, we will inform you of the fact as soon as is practicable and we will either provide a full refund or rearrange the appointment if you prefer and doing so is possible.  

Where a refund is due we will refund your payment within 7 days of notice of cancellation.

The attendance at appointments with us in our capacity as a health professional requires completion of our consent form. This will be provided to you in advance of your appointment. Please complete this form prior to your appointment.

It is important that you provide complete information about your health at or prior to an appointment with us as a health professional.  Any failure to provide complete and honest information may result in incorrect diagnosis and/or inappropriate or ineffective treatment and we accept no responsibility for any such consequences of your failure to provide the required information.

Events

If you have booked to attend one of our events or courses and cancel with less than 6 weeks’ notice, or fail to attend the event, we reserve the right to charge you in full for that event or course.  

If you have booked to attend one of our events or courses and cancel with more than 6 weeks’ notice, we reserve the right to charge you an administrative fee for the cancellation. This fee will not exceed 25% of the event or course price and the fee we charge will depend on whether we are able to refill your space.  

If we have to cancel an event or course you have booked, we will inform you of the fact as soon as is practicable and we will either provide a full refund or if you prefer and doing so is possible offer you a place at an alternative event.

We will refund your payment through Stripe within 7 days of notice of cancellation.

We reserve the right to refuse entry to any event which we run or lead, or to require you to leave that event immediately if we consider you are not in a fit state to participate or if we consider your behaviour is inappropriate. You will not be entitled to a refund in these circumstances and if you have not yet paid, we reserve the right to charge you in full for that event. 

We reserve the right to make changes to the advertised timetable and programme as necessary.

It is your responsibility to inform us in advance of any allergies or other health issues which may require us to make appropriate provision for you or which might impact the appropriateness of you attending or taking part in any event or course which we run or lead.

Products

We aim to dispatch all orders within 4 working days of receipt of your order. However, we cannot dispatch to you unless you have provided us with the information we request in our order form. Parcels are normally dispatched using Royal Mail first class post to the UK.

Cost of post and packaging are based on the cost to us of packaging and posting products.

We reserve the right to cancel orders or withdraw products should we consider it necessary to do so. 

We reserve the right to refuse to supply you with any of our products if we consider it appropriate to take this action.

If you are not happy with a product you have received from us for any reason, please email us within 48 hours of receipt of your goods to discuss its return and refund.

Payment

Payment for any service or product and any refund will be through Stripe or, with our agreement, by direct payment to our bank account on receipt of an invoice from us.  

The use of Stripe is governed by Stripe own terms and conditions and we accept no responsibility for the acts or omissions of Stripe or for the operation of its services.

Payment for any services or products ordered through our website is due at the time the order is made. Payment for appointments or products arranged directly with us is due within 7 days of the date of the invoice. Failure to adhere to this timescale entitles us to cease to provide services and/or products to you.

Intellectual Property Rights

The content of our services and products, including information and advice provided by us, are and will remain our property exclusively and are protected by copyright.

All rights to the name The Peach and related applications are reserved. 

Neither the name The Peach, the name of any of our social media identities nor the website may be used in connection with or associated with any product or service without our prior written consent.

Liability

If attending any of our appointments, events or courses, using any of our services or purchasing any of our products, it is incumbent upon you to complete all details on any registration/order form we provide and to inform us of any allergies or other health issues which may impact the appropriateness of you using our services or products.

Except where we are negligent, we accept no liability for any injury or damage sustained by your use of our services or products.

We do not accept any liability for any third party services or products which are utilised or purchased as a result of information obtained from us including through any link contained on our website or accessed through our social media accounts.

Website and media content

Whilst every effort is made to ensure the content of the website, social media accounts and any other information provided via the website or social media accounts as part of the services or relating to our products is accurate and up to date, we accept no liability for any error or inaccuracy.  We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Whilst the website, social media accounts and any other information provided as part of our services or relating to our products (other than in a one to one appointment) may contain information about health and wellbeing, it does not purport to provide medical advice specific to your circumstances and you should contact an appropriately qualified specialist should you require assistance with your own personal situation.

The website, social media accounts and other information provided to users of services or products contain links to other sites that are not operated by us.  We have no control over and assume no responsibility for the content of those websites or for the use of your data by those websites.

We give no warranty as to the availability of the website, social media accounts or the supply of any other services or products and accept no liability for any temporary or permanent lack of availability.

We reserve the right to terminate or suspend your access to the website, social media accounts or your right or ability to receive any other service or to obtain products from us. We will inform you of the fact as soon as is practicable.
